1. Agreement and business use
These Terms of Service (the “Terms”) govern access to Feedback in Games, including its dashboard, APIs, SDKs and related services (the “Service”). The Service is operated by Christos Sinopoulos SP under the Feedback in Games and Octappush names (“we”, “us” or “our”), with a registered business address at 21st Navarchou Kountouriotou, 54625 Thessaloniki, Greece.
The Service is intended for business and professional use. By creating an account, accepting an invitation, purchasing a package or using the Service, you confirm that you are at least 18 and have authority to bind the business or organisation you represent (the “Customer”). If you do not agree to these Terms, do not use the Service.
2. The Service
Feedback in Games helps Customers create and deliver in-game surveys, collect and analyse responses, manage targeting and translations, and configure in-game or provider rewards. Features may depend on the Customer’s package, SDK version, game configuration and available third-party services.
We may improve, replace or discontinue features. We will provide reasonable notice where a material change significantly reduces paid functionality, unless urgent security, legal or provider constraints require faster action.
3. Accounts and teams
- Provide accurate account and company information.
- Keep credentials, API keys and game keys confidential.
- Use appropriate team roles and promptly remove people who should no longer have access.
- Notify us promptly at support@octappush.com if you suspect unauthorised access.
Team administrators may manage billing, members, games and Customer Data for their team. The Customer is responsible for actions taken through its accounts and credentials unless caused by our breach of these Terms.
4. Customer Data and player data
“Customer Data” means games, survey content, responses, player identifiers, traits, events, files and other information submitted to or collected through the Service for a Customer. The Customer retains its rights in Customer Data and grants us the limited right to host, process, transmit and display it as necessary to provide, secure and support the Service.
The Customer is responsible for the lawfulness, accuracy and content of Customer Data, including providing notices and obtaining any permissions required from players. The Customer must not instruct us to process data it has no right to use or unnecessary sensitive data. Our processing of personal data on the Customer’s behalf is governed by the Data Processing Addendum.
5. Acceptable use
You must not use the Service to:
- violate law, privacy rights or intellectual-property rights;
- distribute malware or attempt unauthorised access;
- interfere with, overload or circumvent Service safeguards;
- misrepresent survey eligibility, reward entitlement or identity;
- send unlawful, deceptive, abusive or discriminatory content; or
- resell or provide the Service to third parties unless we agree in writing.
Reasonable security testing requires our prior written permission. Usage limits and technical controls may be enforced to protect the Service and other Customers.
6. SDK and intellectual property
We grant the Customer a limited, non-exclusive, non-transferable and revocable licence to use our SDK and documentation solely to integrate the Service into games the Customer is authorised to operate. Except for Customer Data, the Service, software, documentation, branding and related intellectual property remain ours or our licensors’.
Feedback and suggestions may be used to improve the Service without restriction or payment, provided we do not publicly identify the Customer without permission.
7. Packages, responses and billing
The Service may include a Free package and paid packages. Package details shown before purchase identify the price, currency, billing interval, included response allowance and enabled features. A response is metered according to the definition shown in the Service. Surveys may stop being served when all available responses are used.
- Renewal. Paid subscriptions renew automatically for the displayed interval until paused or cancelled.
- Upgrades. An upgrade can take effect immediately and may create a prorated charge disclosed through Stripe.
- Downgrades. A downgrade normally takes effect at the next billing period, as shown in the Service.
- Cancellation. Cancellation normally takes effect at the end of the current paid period. Access continues until then.
- Pause. Pausing stops paid access and billing under the conditions shown before confirmation. Resuming may require a payment, which is shown before the Customer confirms.
- Failed payment. We may retry payment and place the package on hold. While on hold, the team receives the Free package until payment succeeds. If the subscription expires or is cancelled, the team returns to Free.
Stripe processes subscription payments and payment-method details. We do not receive complete card numbers. Except where required by law or expressly agreed in writing, charges are non-refundable and cancelling does not refund an elapsed or current billing period.
Prices exclude applicable taxes unless checkout states that tax is included. We may collect taxes where required. The Customer is responsible for providing accurate billing and tax information.
8. Provider-funded player rewards
Customers may connect a supported reward-provider account and use that account to fund provider rewards. The Customer is responsible for its provider account, funding, provider charges and compliance with the provider’s terms.
Reward availability depends on Customer configuration, player eligibility and completion, available provider funds, fraud controls and provider availability. We may block or reject fraudulent, unlawful or duplicate claims.
9. Confidentiality
Each party must protect the other party’s non-public business, technical and commercial information using reasonable care and use it only for the relationship under these Terms. This does not cover information lawfully known without restriction, independently developed, publicly available without breach, or lawfully received from another source. Disclosure required by law is permitted after notice where legally allowed.
10. Third-party services
The Service relies on third parties such as hosting, payment, analytics, translation, email and reward providers. Their own terms may apply to Customer interactions with them. We remain responsible for our obligations under these Terms, but are not responsible for a third-party service outside our reasonable control.
11. Suspension and termination
We may suspend access where reasonably necessary to prevent security harm, unlawful use, non-payment or a material breach. Where practical, we will notify the Customer and allow an opportunity to cure. Either party may terminate for an uncured material breach. Customers may stop using Free and cancel paid subscriptions through the available billing controls.
On termination, access ends and Customer Data may be deleted after a reasonable export or retention period, subject to legal obligations and the Data Processing Addendum. Sections intended by their nature to survive termination remain effective.
12. Warranties and liability
We will provide the Service with reasonable care and skill. Except for that commitment and any rights that cannot legally be excluded, the Service is provided “as is” and “as available”. We do not guarantee uninterrupted availability, a particular survey response rate, or a specific business outcome.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or loss of profits, revenue, goodwill or data. Our total liability arising from the Service is limited to fees paid or payable by the Customer for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited, or to fraud, wilful misconduct, confidentiality obligations or infringement of the other party’s intellectual property.
13. Governing law
These Terms are governed by the laws of Greece, without regard to conflict-of-law rules. Courts in Greece have exclusive jurisdiction, except where mandatory law provides otherwise. Nothing in these Terms limits mandatory rights that legally apply to a Customer.
14. Changes and contact
We may update these Terms. Material changes will be announced through the Service or by email and will apply from the stated effective date. Continued use after that date constitutes acceptance where permitted by law.
